Joe Gibbs Racing (JGR) has announced its intention to amend and refile the lawsuit against Spire Motorsports and Chris Gabehart. This decision renders the responses the defendants were due to file this Monday ineffective.

In this context, JGR has notified the U.S. District Court for the Western District of North Carolina of its intent to file a Second Amended Complaint. This move was necessary after the defendants requested a copy of this new complaint from JGR to decide whether they would consent to its filing.

The initial complaint was filed against Gabehart on February 19, claiming damages of $8 million for allegedly devising a plan to steal proprietary data and share it with his new company, Spire Motorsports. The court has set JGR’s desire to start the trial on December 7, before the start of the 2027 season.

However, the defendants have argued that this schedule is too expedited for a fair defense, although they acknowledge that an earlier trial would be appropriate. JGR has emphasized that Spire’s increasing success in races is an urgent reason to resolve the legal controversies as quickly as possible.

Furthermore, there is a discrepancy regarding Gabehart’s active role at Spire. JGR pointed out that Gabehart has been observing the races more closely than he is allowed, raising doubts about whether he is following the court’s order. Spire, for its part, has denied the allegations that Gabehart is acting inappropriately.
