23XI Racing and Front Row Motorsports has requested the court to seek documents from Liberty Media and its deal with F1 teams, in their antitrust case against NASCAR.
The ongoing case between 23XI Racing and Front Row Motorsports has spiraled out to bring Liberty Media and F1 in the picture when they are not involved in any of the matter. The former is fighting a antitrust case against the NASCAR championship, where they compete as a team.
23XI Racing is co-owned by Michael Jordan, Denny Hamlin and Curtis Polk, while Front Row Motorsports is headed by Bob Jenkins and Brad Jenkins. The case relates to the two teams going against the NASCAR championship, especially with regards to how it manages the finances and pays the team.
They feel the championship with their charter have a monopoly and are not fair with distribution of the money earned by the series. In order to strengthen their case, 23XI Racing and Front Row Motorsports wrote to Liberty Media in a request to present their Concorde Agreement in the court.
They want them to show how their agreement works with the F1 teams getting good share of money earned by the Formula 1 championship. All the documents requested is related to the revenue, how it is split, how much the teams is valued at, the Concorde Agreement, and more.
Liberty Media, however, denied giving away such details and be dragged into the court drama. 23XI Racing and Front Row Motorsports acknowledged the response but still pushed for the details for the time period between January 1 of 2016 and December 21 of 2024.
With Liberty Media not responding, they have now pressed the Federal District Court of Colorado to force the American company to share the details in court for their case against NASCAR. “First, the subpoena is overbroad in its entirety,” said Liberty Media in their initial statement.
“Liberty Media has no connection to the underlying action between Plaintiffs and Defendants NASCAR and James France. [It is] undue and substantial infringement on its right to maintain confidential some of its most closely guarded trade secrets and business information….Formula 1 is a subsidiary and that the federal district court has no standing in the matter anyway.”
